1. Enrollment in eXp Luxury
I will become enrolled in eXp Luxury effective as of the date that the last of the three Enrollment Conditions have been satisfied (the “Effective Date”), and I shall remain enrolled in eXp Luxury unless or until removed by eXp, or I withdraw from eXp Luxury. Termination of my Independent Contractor Agreement (“ICA”) shall constitute my removal from eXp Luxury. eXp reserves all rights to, (a) reject my enrollment into eXp Luxury, and/or (b) remove me from eXp Luxury at any time, for any reason, and without reimbursement to me. This Application shall remain as an application until such time as all of the Enrollment Conditions have been satisfied, whereupon it will be and become a binding addendum to my ICA.
1. Enrollment Periods
- Initial Enrollment Period. If the Effective Date is the first (1st) day of a calendar month, then the initial period of my enrollment in eXp Luxury shall end upon the last day of the calendar month that is eleven (11) complete calendar months thereafter; conversely, if the Effective Date is any day other than the first (1st) day of a calendar month, then the initial period of my enrollment in eXp Luxury shall end upon the last day of the calendar month that is twelve (12) complete calendar months thereafter (respectively, the “Initial Enrollment Period”). For example, if my Effective Date is November 13, 2023, then my Initial Enrollment Period shall begin on November 13, 2023, and remain in effect until December 31, 2024.
- Renewed Enrollment Periods. Following completion of the Initial Enrollment Period, I will be automatically re-enrolled in eXp Luxury for subsequent periods of one year (each, a “Renewed Enrollment Period”, and collectively with the Initial Enrollment Period, the “Enrollment Period”), and I shall remain re-enrolled in eXp Luxury unless or until removed by eXp or I withdraw from eXp Luxury. For avoidance of doubt, the terms within this Application shall apply during the entire Enrollment Period.
1. Enrollment Fees; Luxury Listing Center Fees; Certification Course Fee; Payment Methods
- Enrollment Fees. I shall pay a reoccurring enrollment fee (per Enrollment Period) of $2,500.00 (U.S.) plus applicable sales tax (“Enrollment Fee”). However, if I am a team member on an eXp team, and the team leader of that eXp team is himself or herself enrolled in eXp Luxury, then I shall pay a reduced Enrollment Fee of $995.00 (U.S.) plus applicable sales tax (“Team Member Enrollment Fee”) for so long as, (i) I remain enrolled in eXp Luxury, (ii) I remain on their eXp team, and (iii) my team leader remains enrolled in eXp Luxury. eXp reserves all rights to increase, decrease, or maintain the Enrollment Fee (or Team Member Enrollment Fee, as applicable) for any upcoming Renewed Enrollment Period prior to the commencement of that Renewed Enrollment Period. The Enrollment Fee (or Team Member Enrollment Fee, as applicable) shall be due and payable upon the Effective Date, and shall be reassessed within thirty (30) days prior to the beginning of each upcoming Renewed Enrollment Period. The Enrollment Fee and Team Member Enrollment Fee are each non-refundable. eXp reserves all rights to offer, modify, suspend, and/or revoke a discounted Enrollment Fee (and/or a discounted Team Member Enrollment Fee), at any time and for any reason, as determined in its sole and absolute discretion.
- Luxury Listing Center Fees. If I am paying the Enrollment Fee, then I shall pay $199 per listing (plus applicable sales tax) for each additional active, concurrent listing over the tenth (10th) listing within the Luxury Listing Center. If I am paying the Team Member Enrollment Fee, then I shall pay $199 per listing (plus applicable sales tax) for each additional active, concurrent listing over the fifth (5th) listing within the Luxury Listing Center.
- eXp Luxury Certification Course Fee. I shall pay a one-time fee of $595 (U.S.) (plus applicable sales tax) for enrollment and participation in the eXp Luxury Certification Course.
- Payment. I am solely responsible for ensuring that my payment methods remain current in eXp’s electronic payment portal (accessible by me through the eXp Enterprise system). I authorize eXp to use my then-current payment methods, on file in eXp’s electronic payment portal, for payment of each initial and recurring Enrollment Fee (or Team Member Enrollment Fee, as applicable), and all other fees to be paid by me to eXp hereunder.
1. Benefits of Enrollment
For so long as I remain enrolled in eXp Luxury, I will be entitled to receive those benefits as set forth on the eXp Luxury benefits form available here: http://expluxury.com/benefits (the “eXp Luxury Benefits”), which benefits may be subject to change, addition, and/or removal by eXp at any time, without notice to me.
1. eXp Luxury Trade Name and Logo
While enrolled in eXp Luxury, I am granted a revocable license to use eXp’s “eXp® Luxury” trade name and logo (collectively, “eXp intellectual property”) for real estate brokerage branding and marketing purposes, all in accordance with the terms and conditions of the eXp Luxury Brand Guidelines then in effect. The eXp Luxury Brand Guidelines and logo are each available for download and review at https://expluxury.com/brand. To the extent eXp determines that my use of any eXp intellectual property is prejudicial to eXp, I shall cease or modify such use in accordance with and upon notice by eXp, at eXp’s sole discretion. I will not acquire any ownership interest in any eXp intellectual property.
1. Privacy Policy; Receipt of Promotional Information
eXp uses personal information collected about me in order to support my continued affiliation with eXp. Such use includes, without limitation, sending me promotional information about existing and new services, products, and special offers of eXp and its affiliates, all as more fully provided in the eXp World Holdings, Inc. Privacy Policy and Data Processing Policy, available at https://expworldholdings.com/privacy-policy/ (the, “Privacy Policy”). By submitting this Application, I represent and warrant to eXp that I have reviewed the Privacy Policy, understand the Privacy Policy, and upon enrollment as a member in eXp Luxury, agree to be bound by its terms, including receiving promotional information about existing and new services, products, and special offers of eXp and its affiliates.
1. Additional Terms
If or when the Enrollment Conditions have been satisfied, this Application will become a binding addendum to my ICA. If any conflicts exist between the terms contained in this Application and the terms contained in my ICA, the terms of this Application shall govern and control. Except as provided in this Application, in all other respects the terms contained in my ICA shall remain in full force and effect, and continue uninterrupted. This Application (together with each of the websites referenced herein) embodies the complete agreement and understanding among eXp and me with respect to the subject matter of this Application, and supersedes any prior understandings, agreements, or representations by or among me and eXp which may have related to the subject matter of this Application in any way. If there is any conflict between the terms of this Application, and the terms set forth on any incorporated website, the terms on the incorporated website shall govern and control. No failure to exercise, and no delay in exercising, any right or any power hereunder shall operate as a waiver thereof. My acceptance of the terms and conditions in this Application shall be represented by my checking the above two boxes and clicking the “Next” button, consistent with the Electronic Signatures in Global and National Commerce Act (ESIGN Act) (15 USC § 96) (inclusive of its implementing rules and regulations), as may be amended or succeeded from time to time hereafter, together with any applicable state law, rule, and/or regulation which is similar, comparable, analogous, or equivalent to any of the foregoing. Any provision of this Application that, by implication, should come into or continue in force on or after termination of this Application shall remain in full force and effect after termination of this Application. All references to “I,” and “me” in this application, shall mean to that specific defined term used to describe me, as set forth in my ICA; all references to “eXp” shall mean to eXp Realty, LLC and its subsidiaries. For avoidance of doubt, I agree that eXp may act directly under this Application, or indirectly through its appointed agent, Luxaddress LLC d/b/a LUXVT.
